Former President Trump Seeks Supreme Court Permission for State Guard Forces in the State of Illinois

On the end of the week, the White House filed an emergency request to the nation's highest court, seeking clearance to send state guard personnel to Chicago and surrounding areas.

This move is part of a larger effort to widen the internal deployment of the military in multiple cities run by Democrats.

Judicial Challenge Over Guard Activation

In an urgent petition, the US Department of Justice pressed the judiciary to reverse a lower court ruling that had blocked the stationing of hundreds of military reserve members to the greater Chicago.

The presiding judge had voiced concerns about the administration's reasoning for activating the guard, challenging its reasoning in considering regional circumstances.

A higher court supported the previous order on the previous day, leaving the deployment on hold while the court case proceeds.

Administration's Arguments

The solicitor general, speaking on behalf of the administration, wrote in the new filing that federal law enforcement have frequently been “threatened and attacked” in downtown Chicago and the outlying area of Broadview area.

This site is home to an Immigration and Customs Enforcement holding center.

The president has previously deployed state guard personnel to the Windy City and the city of Portland, following prior activations to Los Angeles, Memphis, Tennessee, and Washington, District of Columbia.

The administration has argued that troop deployment is necessary to reduce protests and support border control.

Partisan Opposition

Elected Democrats have strongly opposed the action, arguing that the administration's assertions are greatly exaggerated and partisan in nature.

They accuse the former president of abusing his executive power to target political rivals.

The judiciary have also raised questions about the White House's description of events.

Regional authorities state that demonstrations over deportation policies have been mostly modest and calm, challenging the former president's characterization of “battlefield” conditions.

Legal Basis

At the center of the conflict is the president’s use of a national law authorizing the commander-in-chief to federalize the national guard only in cases of uprising or when “incapable with the regular forces to execute the laws of the US”.

The government maintains that the troops are required to defend US facilities and officers from demonstrators.

Earlier this month, the White House federalized 300 troops of the Illinois military reserve and directed more Texas-based forces into the Illinois.

As state authorities condemned the decision, the former president intensified his language, demanding the detention of Chicago’s mayor and the Illinois governor, the two Democratic officials, alleging them of not managing to safeguard ICE personnel.

Illinois and municipal government jointly sued the White House to block the sending.

On October 9, district Judge April Perry, nominated by President Biden, delivered a preliminary order blocking the directive.

At the same time in the Chicago area, at least 11 people were taken into custody outside the federal detention center following serious disputes between Illinois state police and demonstrators.
